On June 12, 2019 the Guam Supreme Court ruled in favor of the Antonio B. Won Pat International Airport Authority, Guam (“GIAA”) in its ongoing dispute with DFS Guam L.P. clarifying issues around the Open Government Law (OGL) and the Sunshine Reform Act of 1999 (Sunshine Act) by ruling that under the Sunshine Act a Guam public agency is permitted to withhold executive session transcripts when they pertain to ongoing litigation even if not sealed under the OGL. CFJ's Kathy Fisher and Genevieve Rapadas argued the case before the Supreme Court. As a result of this opinion, the Supreme Court dismissed DFS's related appeal for attorney's fees and costs of over $260,000 which it was unsuccessful in obtaining in the Superior Court.
